Agreement to Terms

These Terms of Service ("Terms," "Agreement") govern your use of the BranchBound website located at https://branchbound.app (the "Service," "Website") operated by BranchBound ("we," "us," "our," or "Company").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Description of Service

BranchBound is an AI-powered interactive storytelling platform. Users experience stories by selecting from predefined choices within the interface. The system then uses artificial intelligence to generate story content based on those selections.

The Service may include:

  • Choice-based interactive storytelling and AI-generated scenes based on your selections (not open-ended user prompts)
  • Discovery features such as browsing stories, characters, genres, and related catalog content
  • User accounts, saved play sessions, and optional session settings (for example public or private visibility)
  • Free and paid subscription tiers with different limits (such as concurrent sessions, story length options, and use of premium AI models)
  • In-platform virtual balances or items (for example coins and crystals) used to access certain generation features, as described in the Service
  • Payments processed by third-party providers (for example subscription checkout and billing management)
  • Experimental or beta features

Content generated by the Service is produced automatically by machine learning systems based on user choices and may sometimes produce inaccurate, unexpected, or inappropriate results.

BranchBound does not guarantee the quality, accuracy, or appropriateness of generated content.

Accounts and Security

Certain features require you to create an account. You agree to provide accurate information and to keep it up to date.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us promptly if you suspect unauthorized access

We may refuse registration, suspend, or close accounts that violate these Terms or present security or abuse risk.

Subscriptions, Payments, and Virtual Balances

Some features require a paid subscription or use of in-platform virtual balances. Prices, tiers, and included benefits are described on the Service (for example the subscriptions page) and may change with reasonable notice where required.

Third-party payment processing

Subscription payments and related billing may be processed by third-party providers (such as Stripe). Your use of those payment services is also subject to the provider's terms and privacy practices. We do not store your full payment card details on our servers.

Billing and cancellation

Recurring subscriptions renew according to the plan you select until you cancel through the billing management tools we provide or as described in the Service. You are responsible for applicable taxes.

All subscription fees are non-refundable once charged, including partial billing periods, except where required by applicable law. If you believe a charge is in error, contact us using the information below.

Plan changes (upgrades and downgrades)

If you upgrade to a higher subscription tier, the change takes immediate effect and you pay only the prorated difference for the remainder of your current billing period.

If you downgrade to a lower tier, the change takes effect at the end of your current billing period. You retain access to your current tier's benefits until that date. No refunds are provided for downgrades.

Billing interval changes

If you switch to a longer billing interval (for example, monthly to yearly), the new interval takes immediate effect and you pay the prorated difference.

If you switch to a shorter billing interval (for example, yearly to monthly), the new interval takes effect at the end of your current billing period.

Special case: if you upgrade to a higher tier while also switching to a shorter interval, the change is immediate. You will move to the new tier on the shorter interval right away; however, any upfront rewards already received for the longer interval are not granted again. Credits from proration are applied toward upcoming payments on the shorter interval.

Proration and credits

When plan changes result in a price difference, charges are prorated based on the time remaining in your current billing period. Any eligible credits are applied to future payments automatically.

Virtual balances

Virtual coins, crystals, or similar in-platform balances are a limited license to use features of the Service, not real money, stored value, or property. They have no cash value, are non-transferable except as the Service explicitly allows, and may be modified, reset, or discontinued as we update the product.

We may impose earning limits, expiration, or anti-abuse rules. Unlawful trading or sale of accounts or balances outside the Service is prohibited.

Acceptance and Eligibility

Age Requirements

You must be at least 13 years of age to use this Service.

By using the Service, you represent and warrant that you meet this requirement.

Capacity

By using our Service, you represent and warrant that:

  • You have the legal capacity to enter into this Agreement
  • You are not prohibited from using the Service under applicable law
  • Your use of the Service will not violate any applicable law or regulation

Permitted Uses

You may use our Service for the following purposes:

  • Experience interactive stories by making choices and selecting from available options
  • View and engage with AI-generated story content
  • Use generated content for personal or commercial projects, subject to these Terms, your subscription or entitlements, and applicable law
  • Access features and tools offered through the Service within the limits of your account tier

Prohibited Uses and Conduct

You agree NOT to use the Service for any of the following prohibited activities:

Data Misuse

  • Scraping, harvesting, or systematically collecting data from the Website
  • Using automated tools, bots, or scripts to access or extract information
  • Reverse engineering or attempting to replicate our AI systems

Technical Interference

  • Attempting to gain unauthorized access to our systems, servers, or networks
  • Interfering with or disrupting the Service or servers connected to the Service
  • Introducing viruses, malware, or harmful code
  • Circumventing security measures or safeguards

Fraudulent or Harmful Activities

  • Intentionally seeking, sharing, or distributing illegal, abusive, or harmful content through the Service
  • Using the Service to produce or distribute deepfakes intended to deceive or harm others
  • Impersonating real individuals without permission
  • Sharing or distributing defamatory, threatening, or harassing content
  • Engaging in illegal activities using the Service
  • Abusing promotions, referrals, virtual balances, or payment systems (including chargebacks in bad faith)

Community and acceptable use

Content standards for what may not be requested, displayed, or shared through the Service are described in our Content Policy. Violations may result in removal of content or suspension of your account.

Commercial Misuse

  • Using the Service to compete directly with BranchBound
  • Redistributing or reselling the Service without authorization
  • Using generated outputs to build competing AI models without permission

User Actions and Responsibility

You interact with the Service primarily by selecting from predefined choices and configuring session options offered in the interface (such as story settings). The system generates content from those inputs together with the story's configuration. The experience is not an open-ended prompt box unless the Service explicitly provides that capability.

If you mark a play session as public or otherwise make session content visible to others, you understand that generated text may be accessible to other users or visitors as designed in the Service, and you remain responsible for not using the Service in ways that violate law, these Terms, or others' rights.

By using the Service, you agree to:

  • Use the Service only for lawful purposes.
  • Not attempt to misuse, manipulate, or reverse engineer the system.
  • Not use generated content in ways that violate applicable laws or the rights of others.
  • Accept that content is produced automatically by the system and may not always be accurate, appropriate, or suitable for all situations.
  • Accept responsibility for how you choose to use or share any content generated through the Service.

We reserve the right to monitor, review, remove, or block choices, selections, or generated content that violate these Terms or that may cause harm to the Service or other users.

AI-Generated Content

The Service uses automated systems and artificial intelligence technologies to generate content based on system processes and user selections.

Content generated by the Service is provided for informational or entertainment purposes only and may occasionally contain inaccuracies or unintended results. The Company does not guarantee the accuracy, reliability, or appropriateness of any generated content.

Users should use discretion when relying on or sharing generated content.

Users are responsible for how they use or distribute generated content.

Ownership of Generated Content

Users may use AI-generated story content created through the Service for personal or commercial purposes, subject to these Terms, any subscription or feature limits, and applicable law.

BranchBound retains all rights to the underlying technology, models, systems, and platform used to generate the content.

Generated outputs may be similar or identical to content generated for other users, and BranchBound does not guarantee uniqueness of generated content.

Users may not claim ownership of the Service itself or the AI systems used to generate content.

Intellectual Property Rights

Our Intellectual Property

The Service and all content, features, and functionality are owned by BranchBound and are protected by applicable intellectual property laws. This includes:

  • Website design and user interface
  • Proprietary AI systems and algorithms
  • Branding, trademarks, and logos
  • Software and platform infrastructure

Limited License to Users

We grant users a limited, non-exclusive, non-transferable license to access and use the Service for personal or commercial creative purposes.

Restrictions

You may not:

  • Copy or distribute our software or platform
  • Reverse engineer our AI models
  • Use our branding without permission
  • Build competing systems using our Service outputs

Privacy and Data Protection

Your privacy is important to us.

Our collection and use of personal data is governed by our Privacy Policy.

Rules for acceptable content and enforcement are described in our Content Policy.

By using the Service, you consent to the data practices described in our Privacy Policy.

Disclaimers and Warranties

Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

We disclaim all warranties including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Continuous or error-free operation

We do not guarantee that generated content will meet your expectations or be suitable for any use.

Limitation of Liability

To the maximum extent permitted by law, BranchBound and its affiliates shall not be liable for any damages including:

  • Loss of data
  • Loss of profits
  • Misuse of generated content
  • Loss of access to virtual balances or subscription features
  • Legal claims arising from content generated through the Service or from user conduct
  • Any indirect or consequential damages

Indemnification

You agree to defend and indemnify BranchBound against any claims, damages, liabilities, or legal costs resulting from:

  • Your use of the Service
  • Your choices, selections, or use of generated content
  • Your violation of these Terms
  • Your violation of any third-party rights

Termination

We may suspend or terminate access to the Service if you violate these Terms or engage in harmful activities.

You may stop using the Service at any time. Cancellation of a paid subscription follows the billing tools and timing described in the Service; termination of your account may affect access to virtual balances and saved sessions as implemented in the product.

If you delete your account while an active subscription exists, the subscription is automatically canceled at the end of the current billing period. No refunds are provided for account deletion, including any remaining time on the current period.

Upon termination:

  • Your right to use the Service ends immediately
  • Any active subscription is canceled at the end of the current billing period with no refund
  • Access to virtual balances, saved sessions, and account data is permanently removed
  • Certain provisions will survive termination

Modification of Terms

We may update these Terms at any time.

Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service constitutes acceptance of the updated Terms.

Dispute Resolution

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules that would apply another jurisdiction's law.

Any disputes arising from the Service will be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in court for misuse of intellectual property or unauthorized access to the Service.

If a court or arbitrator holds that any part of this dispute resolution section cannot be enforced as written, that part will apply only to the minimum extent required, and the remainder of these Terms will stay in effect.

Class Action Waiver

To the fullest extent permitted by law, you agree that disputes will be resolved individually and not as a plaintiff or class member in any class or representative proceeding.

Miscellaneous Provisions

Entire Agreement

These Terms, together with our Privacy Policy and our Content Policy, constitute the entire agreement between you and BranchBound regarding the Service.

Severability

If any provision is found invalid, the remaining provisions remain in effect.

Force Majeure

We are not liable for delays or failures due to events beyond our control.
